CALIFORNIA CONSUMER PRIVACY ACT. To the extent applicable, AZ Mortgage Broker, LLC and consumer agree as follows:
- Personal Information. “Personal Information” means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Information does not include publicly available information.
- Prohibitions. AZ Mortgage Broker, LLC is prohibited from:
i. Retaining, using, or disclosing Personal Information for any purpose other than for the specific purpose of performing the services specified in the Agreement, or as otherwise permitted by California Civil Code § 1798.100 et seq. or other applicable privacy law, including retaining, using, or disclosing Personal Information for a commercial purpose other than providing the services specified in the Agreement;
ii. Selling Personal Information; and
iii. Retaining, using, or disclosing Personal Information outside of the direct business relationship between consumer and AZ Mortgage Broker, LLC.
- Certification. AZ Mortgage Broker, LLC certifies that it understands the restrictions in Paragraph B above and will comply with them.
Deletion. Upon instruction from consumer that AZ Mortgage Broker, LLC has received a verifiable consumer request to delete Personal Information that AZ Mortgage Broker, LLC has collected from the consumer, the company will delete that Personal Information if allowed by law and California Finance Lenders License and/or California Department of Business Oversight and provide consumer with confirmation of deletion. There are some instances the “company” may be required to keep records based on State and National compliance requirements.
AZ Mortgage Broker, LLC responsibility under this paragraph shall only apply to ancillary systems under AZ Mortgage Broker, LLC control.
